DRA 21/2016 Kilcoo v Down CCC & Ulster HC.

An application to the DRA by Kilcoo, challenging a decision by the Down CCC in the awarding of the Down Division 1 ACFL title of 2016, was upheld by a DRA Panel at a hearing at the Carrickdale Hotel, Louth on 12 Jan 2017. The DRA Tribunal (Pat Purcell BL, David Curran, solicitor & Jarlath Burns) decided to remit the matter to Down CCC. On application from the parties, however, the DRA was authorised, pursuant to its power under section 11.4 of the DRA Code, to act as the body of last resort on the matter. The DRA Tribunal then mandated that: (i) Down CCC provide that the schedule of fixtures for Round 1 of the 2017 Down Division 1 ACFL includes a fixture between Kilcoo and Castlewellan, to be held at a neutral venue, and that that fixture would act both as a 2017 league fixture but also as the final of the 2016 ACFL Div 1; (ii) the second, scheduled 2017 league meeting between the teams also to be held at a neutral venue; and (iii) the gate receipts from both fixtures to be shared equally. As this decision is made pursuant to section 11.4 DRA Code, it cannot be held susceptible to further appeal or review. No application for costs were made by Kilcoo against the respondents.
